1. Acceptance of Terms

By accessing or using Gatherino ("the Service"), operated by Pikastore s.r.o., IČO: 19693311, with registered office in the Czech Republic ("we", "us", "the Company"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Gatherino is a form building, submission management, and data export platform. Features include multi-step form creation, conditional logic, PDF generation, file uploads, e-signatures, and integrations with third-party services including accounting software.

3. Eligibility

You must be at least 16 years old to create an account. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these terms.

4. User Accounts

You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate and complete information when creating an account. You must notify us immediately of any unauthorized access.

5. Your Content

You retain all rights to the forms you create and the data you collect. By using the Service, you grant us a limited license to host, process, and display your content solely to provide the Service. We do not claim ownership of your data.

6. Data and Privacy

Your data remains yours. We process data only to provide the Service. See our Privacy Policy for details on how we handle your information. If you collect personal data from third parties via forms, you are responsible for ensuring you have a lawful basis to do so.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Distribute malware, spam, or phishing content.
• Collect sensitive personal data (health, financial, biometric) without appropriate safeguards.
• Infringe the intellectual property or privacy rights of others.
• Attempt to gain unauthorized access to the Service or its infrastructure.
• Use automated tools to scrape or overload the Service.

8. Subscription & Payments

Paid plans are billed monthly via Stripe. You may cancel at any time; access continues until the end of the billing period. We may change pricing with 30 days’ notice. Refunds are provided at our discretion.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability. We will make reasonable efforts to notify you of planned downtime in advance.

10. Termination

You may delete your account at any time via Settings. We may suspend or terminate your account if you violate these terms, with notice where practicable. Upon termination, your data will be deleted within 30 days unless retention is required by law.

11. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Governing Law

These terms are governed by the laws of the Czech Republic. Any disputes shall be resolved by the competent courts in the Czech Republic, without prejudice to any mandatory consumer protection provisions of your country of residence.

13. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Continued use after that date constitutes acceptance.
